The Supreme Court, while giving its opinion on the Senate elections, said that the Senate elections will be held under the Constitution and the law. Senate elections cannot be held by open ballot.

The larger bench of the Supreme Court ruled by a 4-1 majority. Justice Yahya Afridi disagreed. Chief Justice Gulzar Ahmed read out the safe opinion. The court said that Senate elections are held under the constitution and law. At the last hearing, after the arguments of the Attorney General of Pakistan and other parties were completed, the Supreme Court had reserved its opinion.

In its opinion, the court also said that the Election Commission can take all steps for transparent elections. The vote cannot be kept secret forever. It is the job of the Election Commission to eradicate corruption from the electoral process. The Election Commission can also use technology to eradicate corruption.

The court also said that all the institutions are bound to cooperate with the Election Commission. Parliament can amend the constitution. Senate elections will be held under Article 226 of the Constitution. In an earlier hearing, the Chief Justice of Pakistan had said that the question before the court was only a matter of implementation of Article 226. It is also worth mentioning here that the presidential reference was filed in the Supreme Court on December 23. On January 4, a five-member larger bench held its first hearing. Political parties were also offered written opinions.

The attorney general completed his arguments from January 11 to February 17. The court also heard the views of lawyers’ organizations including PPP, PML-N, Jamiat Ulema-e-Islam, and Jamiat-e-Islami. After a total of 20 hearings, the court reserved its opinion.

The position of political leaders

Pakistan Peoples Party (PPP) Chairman Bilawal Bhutto Zardari has said that Pakistan Democratic Movement (PDM) has defeated the government in the by-elections of the entire country. DM preparation is complete whether it is a secret ballot or an open ballot.

Jamiat Ulema-e-Islami chief Maulana Fazlur Rehman had said that the summit would be held immediately after the Senate elections and a new strategy would be formulated.

Ruling party leader and special assistant Shahbaz Gul had said that whether it was PPP or PDM, they could not win the Senate election. He claimed that many people in the PDM were in touch with him.
